DUI/Impaired Driving


Impaired driving refers to operating a motor vehicle while under the influence of alcohol, drugs, or a combination of both. In Canada, the terms "Driving Under the Influence (DUI)" and “Impaired Driving” are often used interchangeably to describe this offence. 

The legal limit for blood alcohol concentration (BAC) is 80 milligrams of alcohol per 100 millilitres of blood (0.08%). For drug-impaired driving, the limits vary depending on the substance. 

Types of Impaired Driving Charges

Impaired driving charges encompass a range of offences related to driving under the influence of alcohol or drugs. 

  • Impaired Driving: Operating a motor vehicle while under the influence of alcohol, drugs, or a combination of both. This charge is based on observed signs of impairment such as erratic driving or slurred speech.
  • Driving Over 80 or "Over 80": Driving with a blood alcohol concentration (BAC) exceeding 80 milligrams of alcohol per 100 millilitres of blood (0.08%). 
  • Refusing a Breathalyzer or Drug Test: Failing or refusing to provide a breath or bodily fluid sample for alcohol or drug testing when required by a law enforcement officer. 
  • Drug-impaired Driving: Operating a motor vehicle while under the influence of drugs, including both legal and illegal substances. 
  • Impaired Driving Causing Bodily Harm: Driving under the influence of alcohol or drugs and causing bodily harm to another person as a result of the impairment. 
  • Impaired Driving Causing Death: Driving under the influence of alcohol or drugs and causing the death of another person as a result of the impairment.
