Criminal Process

1. Initial Consulation

We'll Discuss The Details of Your Case

During our initial consultation we'll provide clarification on the legal process and gather information about the nature of the charges, any available evidence, and learn about your personal circumstances.

2. Disclosure Review

Examination and Analysis of The Prosecution's Evidence

The purpose of disclosure review is to carefully scrutinize the evidence provided by the prosecution and to assess its strengths and weaknesses. This process helps us to develop a comprehensive understanding of the case and strategize the best defence.

3. Discuss Your Options

We'll Discuss The Details of Your Case

Based on our findings in the disclosure review, we'll discusses defence strategies and available options with you. In our discussions we will consider potential defences, negotiation opportunities, and alternative sentencing options to determine the best course of action.

Potential Outcomes

Proceed to Trial

Challenge the Charges

Trial dates are usually set months after the first court appearance. At trial, the judge reviews all evidence, including witness testimonies. If your rights were violated, we may file a Charter Application to exclude evidence or seek dismissal of charges. This protects your rights and ensures unlawful evidence is not considered.

Reach a Resolution With The Crown

Negotiate a Plea Agreement

The "Crown" refers to the prosecution, which represents the government and presents the case against the accused. It is possible for the defence and the Crown to reach a resolution, also known as a plea agreement or negotiated resolution, prior to or during trial. This occurs when both parties agree to a mutually acceptable outcome instead of proceeding with a full trial.

Plead Guilty To A Lesser Offence

Enter a Guilty Plea To a Lesser Charge

In this scenario, the accused person acknowledges their involvement in the offence but wishes to pursue a more favorable outcome. They can do this by choosing to enter a guilty plea to a lesser charge. The terms of the guilty plea are determined through negotiations with the Crown or as part of a plea agreement.

A Sexual Offence Charge May Lead To Registration In The NSOR

Sexual assault is the unauthorized, intentional touching of another person in circumstances of a sexual nature. Section 271 of the Criminal Code deals with sexual assault and Section 151 of the Criminal Code sets out the law for sexual interference.

An assault charge can lead to serious consequences, including imprisonment

Assault is a broad category of offences involving the intentional application of force to another person without their consent. This can range from threats to physical harm. Section 265 of the Criminal Code of Canada details the laws surrounding assault. Charges can result in significant penalties, making it essential to have experienced legal representation to protect your rights and interests.

A Driving Offence Could Get Your License Stripped and Bestow Hefty Fines

Motorists often lose their license pending a disposition in court and a conviction for a driving offence (for instance for a second DUI) often includes mandatory minimum jail sentences. Hefty fines, losing one’s license, jail time and requiring the installation of an ignition interlock device in your vehicle are all possible consequences. A lawyer can explain the potential consequences in your particular scenario.

Facing robbery charges can lead to severe penalties

Robbery is defined under Section 343 of the Canadian Criminal Code as a theft committed with violence or threats of violence. This distinguishes robbery from other property crimes like theft and break and enter (burglary).

Fraud Charges Can Lead To Serious Financial Penalties and Imprisonment

Fraud is defined as the act of dishonestly obtaining property, money, or valuable services by deception, falsehood, or other fraudulent means. The Criminal Code of Canada outlines fraud-related offences under sections 380 to 382.

Youth Crimes Require Specialized Understanding and Approach

Young offenders are individuals aged 12 to 17 who are accused of committing a crime. The Youth Criminal Justice Act (YCJA) ensures that the rights of young offenders are upheld by governing the legal process.

Domestic Violence Charges Could Affect Parental Rights

Spousal assault refers to any intentional non-consensual application of force enacted against an intimate partner of the same household such as a current or former spouse, common-law partner, or dating partner.

Drug Charges Can Lead To Substantial Fines and Imprisonment

Possession of Narcotics for the Purpose of Trafficking is defined under the Controlled Drugs and Substances Act (CDSA) as possessing a substance included in Schedule I, II, III, IV or V for the purpose of trafficking.

Dangerous Driving Charges Can Impact Your License and Freedom

Dangerous driving is defined under Section 249 of the Criminal Code as operating a conveyance in a manner that endangers the public given the circumstances (e.g., traffic, road conditions, visibility).
