Dangerous Driving
Dangerous driving is defined under Section 249 of the Criminal Code as operating a conveyance in a manner that endangers the public given the circumstances (e.g., traffic, road conditions, visibility).
A dangerous driving charge requires that the driver showed a reckless disregard for public safety and endangered people who were either present or could have reasonably been expected to be present.

Examples of Dangerous Driving
Dangerous Driving can include the following situations:

- Failing to yield to pedestrians or other vehicles when required
- Driving in a manner that is inappropriate for weather or road conditions
- Distracted driving
- Reckless driving
Potential Penalties of a Dangerous Driving Charge
Dangerous driving is treated as a hybrid offence where the Crown ultimately decides whether to prosecute you summarily or by way of indictment.
Dangerous Driving
- Summary: Maximum sentence of 2 years less a day imprisonment
- Indictment: Maximum sentence of 10 years imprisonment
Dangerous Driving Causing Bodily Harm
- Summary: Maximum sentence of 2 years less a day imprisonment
- Indictment: Minimum $1,000 fine and a maximum sentence of 14 years imprisonment
Dangerous Driving Causing Death
- Indictment: Strictly an indictable offence with a minimum $1,000 fine and a maximum sentence of life imprisonment.
Situations that contribute to more severe penalties include racing at least one other person, driving while impaired, operating a large motor vehicle, driving without a permit, and having a passenger under the age of 16 in the vehicle.
